2) Purpose
These Terms govern the remote sale of XamIoT SoundSense hardware and accessories.
3) Compatibility & prerequisites
The SoundSense device requires:
- an Internet connection via 2.4 GHz Wi-Fi, and
- the XamIoT SoundSense mobile app.
Without these conditions, the service is inoperative. Using the app without owning a device is not possible.

4) Prices
Prices are in EUR, VAT included (France) and exclude shipping costs. Applicable taxes and delivery fees are shown before payment.
Prices may be updated prior to order confirmation.
5) Orders
Before confirming payment, the buyer must verify the order summary (items, quantities, addresses, prices).
The sale becomes final upon confirmation of payment.
6) Payment
Accepted methods: credit card, Apple Pay, bank transfer, via secure provider [insert provider name].
Products remain the property of the seller until full payment is received.
7) Delivery
Delivery zones, methods, and times are specified during the order process.
Upon receipt, the buyer must inspect the package and report any damage or anomaly to the carrier immediately.
8) Right of withdrawal (EU consumers)
You have 14 days from receipt to withdraw without giving any reason.
Return the product within 14 additional days, in new, complete condition (packaging, cables, manuals).
Refunds (excluding express shipping) are processed within 14 days after receipt and inspection.
Exclusions:
- customized or personalized products,
- unsealed consumables,
- abnormal wear or damage.
Return shipping is at the customer’s expense, except in case of DOA (dead-on-arrival) within 7 days confirmed by support.
9) Legal warranties (France)
- Conformity warranty (Art. L217-3 Consumer Code): 2 years from delivery.
- Hidden defects warranty (Art. 1641 Civil Code).
Covers original manufacturing defects.
Exclusions: misuse, unauthorized modifications, physical damage, surges, humidity, or non-compliance with prerequisites (Wi-Fi 2.4 GHz, proper power supply, etc.).
10) Support & updates

Firmware and security updates may be provided and can be mandatory for safe operation.
11) Liability
Within legal limits, liability is capped at the amount paid for the order concerned.
No liability for indirect damages (loss of data, business interruption, etc.).
12) Recycling & compliance
SoundSense devices must be recycled via an authorized WEEE channel.
Regulatory compliance (CE / UKCA) is printed on the product.
13) Intellectual property
Trademarks, firmware, schematics, and documentation remain the exclusive property of XamIoT.
Any reproduction or reverse engineering is strictly prohibited.
14) Force majeure
Neither party shall be held liable for failure to perform obligations resulting from events of force majeure as defined by French law.

16) Governing law & disputes
French law applies.
Competent courts: Orléans, France (subject to mandatory consumer rights).
